All you need to know about Oyo State Home Owners Charter.

Home Owner Charter is a scheme of the Oyo State Government on residential landed properties. The aim of the government is to allow home owners regularize the legal status and documentation of their properties whilst providing enumeration data for proper planning, provision of roads, schools, hospitals and other essential services by the State Government.

Under the scheme, owners of eligible properties built without title or required approval in Oyo State will be given a window of opportunity to obtain a Certificate of Occupancy. All penalties and fines have been waived, documentation requirements relaxed and fees discounted to enable as many residents as possible to benefit.

Records have shown that the majority of residential landed properties in Oyo State have no registered title, leaving such property holders open to many risks (e.g. defective transfer to heirs and encroachment). Also, the absence of perfected title documents depresses the true value of the property reducing its viability in the financial sector as a credit worthy document.

As a result of lack of proper title documents:

  • Home owners have difficulties using their properties as collateral, for any financial transaction and transferring their properties to 3rd parties.
  • Most properties are undervalued and this regresses the growth of the Oyo State property market preventing all stakeholders from getting the necessary information and thus reducing vibrancy in the property market.
  • There is no accurate data on the actual number of residences in most areas for proper planning and provision of essential social amenities.
  • Documentation which confirms your true status as a Home owner
  • You will enjoy a significant discount in the process to obtain proper legal title to the land (C of O) and your records will be on the digital database for ease of confirmation and transfer.
  • The value of the property will be enhanced and become more marketable as buyers can confidently transact knowing that correct title documentation is available.
  • Property with correct legal status and documentation can be used as collateral for bank loans and other business transactions.
  • Disputes over ownership will be minimized, in the event of death, heirs are sure of a valid inheritance.
  • Property related fraud and problems of Omo-Oniles/Ajagun Gbales would be reduced.
  • Your residential area will benefit from the Oyo State Government’s urban renewal policy through effective planning of facilities in the areas of education, health and other essential infrastructure.

Application forms are available at a fixed rate of Six Thousand Naira (₦6,000.00) payable exclusively using customized Home Owners Charter recharge cards in any of the following locations:

  • Ministry of Lands, Housing and Urban Development, Agodi, Ibadan;
  • All Local Government Authority (LGA) offices;
  • All Local Council Development Areas (LCDA) offices.

Please register your application immediately by following the instructions at the back of the OYHOC recharge card. It is important to note that only applications duly registered with a valid PIN will be processed.

The OYHOC recharge card will serve as receipt of application form payment, while the unique PIN on the recharge card shall serve as application number which has to be inputted on your form and also used for registering your application.

It is expected that the vast majority of residential buildings will fully qualify. However approval will not be granted to the following:

  • Property built under PHCN high tension cable
  • Houses built on designated acquisitions such as agricultural lands.
  • Property occupying “Right-of-way” of the NNPC pipeline.
  • Property built on the “Set-back” of road, water bodies and gullies
  • Property built on flood plains.
  • Substandard or defective properties
  • Property subject to legal dispute.

The scheme is open to all residential property owners which include the rightful legal heir to the demised owner.

All documents relevant to the ownership of the property should be submitted. These include Land Purchase Agreements, Deed of Gift, Receipts, Survey, Applicant Passport photograph and Photograph of the Property, Affidavit etc.

  • On submission of your completed application form you will be issued a demand notice of the expected amount due for processing your application.
  • After the payment of your processing fee, the State Government will publish your application in the national dailies, to ascertain that there are no objections on your property, which will last for Twenty One (21) days from the date of your publication. You will be notified of your publication day and if there is any objection to your application. If there is no objection after the publication, we will schedule inspection with our land officers, surveyors and town planners within 7 days of expiry of the 21 days post publication window for objection.
  • Your C of O will then be processed for collection and you will be notified once this is ready. These process should last for 30 days after the successful inspection.

Table below shows the total amount payable under the Home Owners Charter. The Oyo State Government will bear the cost of survey, planning permission etc for all applicants who do not have them under the OYHOC scheme hence only the amount indicated below is payable by all applicants. Furthermore, the first 2,000 applicants will enjoy 15% discount of processing cost.

Yes, you can pay in maximum of 3 installments. The 1st installment is on submission of your application, 2nd installment is 21 days after submission of application and last installment is on notification that your C of O is ready for collection.

Your property is at risk, due to lack of official title document. The Home Owner Charter Scheme is an extremely generous offer of the Oyo State Government to enable home owners to regularise their property title. It is a once in a lifetime offer, and it is strongly advised that home owners take full advantage of it. Any residential property owner who fails to take advantage of this generous offer will have to apply for the conventional Certificate of Occupancy, which takes much longer time and is more expensive.

All application received between April 1st to December 31st, 2020 will be processed during the amnesty period.

Yes; so long as they are habitable and occupied. Properties that have not been fully completed though habitable are eligible for this scheme. The aim of the scheme is to provide properties in existence and occupied at the present time with title document.

Yes, as long as they are the bona-fide owner of the property, they are eligible to apply and can also apply via this website lands.oyostate.gov.ng

The C of O obtained under the Home Owners’ Charter is the same as the C of O obtained through the conventional application.
